Terms of Business

1. General

These Terms of Business apply to all quotations, bookings and assignments undertaken by Andrew Plant Photography & Video ("the Photographer"). By confirming a booking, the Client accepts these terms unless otherwise agreed in writing.

2. Quotations

All quotations are valid for 30 days unless stated otherwise.

Quotations are based on the information provided at the time of enquiry. Should the scope of the project change, the quotation may be revised accordingly.

3. Booking Confirmation

A booking is confirmed once written acceptance of the quotation has been received.

For new clients or larger projects, a deposit of up to 30% may be required before work commences.

4. Payment

Unless otherwise agreed:

  • Invoices are payable within 14 days of the invoice date.

  • Late payments may incur statutory interest and recovery costs in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

  • Final images or video may be withheld until full payment has been received.

5. Cancellation and Postponement

Client Cancellation

If a confirmed booking is cancelled, the following charges may apply:

  • More than 14 days' notice – no cancellation fee.

  • 7–14 days' notice – 25% of the quoted fee.

  • 2–6 days' notice – 50% of the quoted fee.

  • Less than 48 hours' notice – up to 100% of the quoted fee.

Any non-refundable expenses already incurred will also be payable.

Postponement

Where possible, postponed assignments will be transferred to a mutually convenient date without charge. If postponement results in additional costs or multiple rescheduling, these may be charged.

6. Client Responsibilities

The Client agrees to:

  • Provide suitable access to locations.

  • Obtain any necessary permissions or permits.

  • Ensure products, premises or personnel are ready for photography or filming.

  • Arrange any required health and safety inductions.

  • Nominate a decision-maker where approvals are required during the shoot.

Delays caused by the Client may reduce the amount of work completed within the agreed time.

7. Creative Interpretation

The Photographer will use professional judgement regarding composition, lighting, editing and image selection.

Unless specifically agreed beforehand, artistic style and creative interpretation remain at the Photographer's discretion.

8. Image Selection and Editing

The Photographer will supply edited images or video as agreed in the quotation.

RAW files, unedited footage and project files remain the property of the Photographer and are not normally supplied.

Additional editing or retouching requested after delivery may be chargeable.

9. Delivery

Delivery times provided are estimates.

Whilst every effort will be made to meet agreed deadlines, the Photographer shall not be liable for delays caused by circumstances beyond reasonable control, including client approval delays.

10. Copyright

Copyright remains with Andrew Plant Photography & Video in accordance with the Copyright, Designs and Patents Act 1988 unless otherwise agreed in writing.

The Client receives a licence to use the delivered images or video for the purposes agreed within the quotation.

Images or video may not be sold, transferred, altered or licensed to third parties without prior written permission unless expressly agreed.

11. Portfolio Use

Unless otherwise agreed in writing, the Photographer reserves the right to use commissioned work for:

  • Portfolio

  • Website

  • Social media

  • Awards

  • Marketing and promotional purposes

Where confidentiality applies, this will always be respected if agreed before the assignment.

12. Third-Party Usage

If images are required for use by third parties, advertising agencies, publishers or partner organisations, this should be disclosed before the quotation is accepted so that appropriate licensing can be agreed.

13. Expenses

Reasonable travel, accommodation, parking, courier charges, specialist equipment hire or other agreed expenses will be charged in addition to the quotation where applicable.

Mileage may be charged for assignments outside the local area.

14. Force Majeure

Neither party shall be liable for failure to fulfil obligations due to events beyond reasonable control, including severe weather, illness, industrial action, equipment failure, government restrictions or acts of God.

15. Limitation of Liability

The Photographer maintains professional insurance and takes every reasonable care during all assignments.

In the unlikely event of equipment failure, data loss or circumstances beyond reasonable control, liability shall be limited to the amount paid by the Client for the affected assignment.

The Photographer shall not be liable for consequential or indirect losses.

16. Data Protection

Client information will be handled in accordance with UK GDPR and will only be used for the administration of the assignment and ongoing business communications where appropriate.

17.Client Satisfaction and Acceptance

The Photographer will carry out all assignments with reasonable skill, care and professional judgement, taking into account any brief agreed before the assignment.

The Client is encouraged to provide feedback during the shoot wherever practical. Any concerns regarding styling, composition, expressions, products, locations or creative direction should be raised at the time so that reasonable adjustments can be made.

Photography and videography are creative services, and personal preference is inherently subjective. Dissatisfaction based solely on artistic style, composition, lighting, posing, expressions or other matters of creative judgement shall not constitute grounds for withholding payment, requesting a refund or requiring a reshoot, provided the work has been produced in accordance with the agreed brief.

If the delivered work does not materially meet the agreed written brief due to an error on the part of the Photographer, the Photographer's liability shall be limited, at their discretion, to either:

  • carrying out a reasonable reshoot where practical; or

  • re-editing the delivered images or video where appropriate.

No refunds shall be offered for work that has been completed in accordance with the agreed brief.

18. Acceptance

Confirmation of a booking, payment of a deposit or acceptance of a quotation constitutes acceptance of these Terms of Business.
